We use physical, electronic, and procedural measures to protect people’s personal information (data) in accordance with data protection legislative requirements. With this Privacy Notice we inform you how we will request, collect, store, retrieve, access, modify, transfer, archive, disclose, delete or retire (hereinafter summarized and referred to as “process”) personal information (data) collected about you in the context of a prequalification process to evaluate your possible involvement in clinical studies (“Trial”) performed by or on behalf of Boehringer Ingelheim or other members of the Boehringer Ingelheim group of companies (hereinafter “Boehringer Ingelheim Affiliates”) in collaboration with IQVIA Ltd (hereinafter “IQVIA”).

This policy supplements the information you have received or will receive as part of the clinical trial Informed Consent process. If you are eligible and decide to participate in the trial, the Informed Consent Form and Research Protocol will define and explain in more detail how information about you will be used in connection with and in scope of the Trial.

We will only process your personal information (data) in accordance with applicable data protection and privacy laws.

Personal Information we collect about you

In connection with the prequalification process, Boehringer Ingelheim and IQVIA may process the following types of Personal Identifiable Information (data): first name, middle name(s), surname, date of birth, gender, personal email address, personal contact phone number, personal address (including city, state, zip code) and optional ethnicity. Personal Health Information may also be collected and processed through pre-screening questions such as disease diagnosis, medication, and/or additional information based on the study protocol.

This Privacy Notice applies to the personal information collected about you on or in connection with websites or other digital properties (“Websites”) displaying a link to this Privacy Notice. The Website(s) are provided by a service provider named IQVIA, referred to as Data Processor.

Personal Information processing purposes

Boehringer Ingelheim and IQVIA will process your personal information (data) for the following purposes:

  1. Prequalification of prospective participants for a Trial by processing your Personal Identifiable Information and / or Personal Health Information when you provide such information to us in a questionnaire on our Website(s) and we will use such information to determine if you may be eligible for research study participation (such questionnaires referred to herein as “Study Eligibility Surveys”).
    Legal basis: Fulfilment of a contractual obligation in accordance with Article 6 (1) lit. b GDPR.
  2. Prequalification of prospective participants for a Trial by operating call centers for the purpose of communicating with you to verify that information you’ve provided in Study Eligibility Surveys is accurate and to collect additional Personal Identifiable Information and / or Personal Health Information as needed to determine your eligibility to participate in clinical research studies.
    Legal basis: Fulfilment of a contractual obligation in accordance with Article 6 (1) lit. b GDPR.

Who do we share your Personal Information with?

To fulfil the purposes described above, we may share your personal information (data) internally or externally as follows:

  1. Your participation in a Trial may be made available to other departments at Boehringer Ingelheim Affiliates that communicate with you, such as medical scientific liaisons, who will interact with you and advise you in the most efficient way.
  2. We may share your personal information (data) for the purposes mentioned above also with other Boehringer Ingelheim Affiliates.
  3. We may share your personal information (data) with third party service providers, such as clinical research organizations, couriers or other service providers delivering services related to the conduct of Boehringer Ingelheim Trials.

Your personal information (data) may be accessed by staff or suppliers in, transferred to, and / or processed and / or stored at, a destination outside the European Economic Area (EEA) in which data protection laws may be of a lower standard than in the EEA. Regardless of location or whether the person is an employee or contractor we will impose the same data protection safeguards that we deploy inside the EEA and have, in compliance with applicable law, taken steps to ensure that your personal information (data) remains secure. For example, we put in place contractual protections that have been approved by competent bodies in the EU.

Retention of Personal Information

Boehringer Ingelheim maintains your personal information (data) for as long as necessary for the purpose of the processing. We will store your personal information (data) related to the prequalification process for a maximum period of two (2) years from campaign end.

Technical Information we collect

The Data Processor will collect browsing information using Cookies (as defined below), Web Logs (as defined below), or IP Address (as defined below).

Cookies

Our Website(s) collect non-identifiable web usage data about your use of our Website(s) using Cookies. A Cookie is a small piece of information that our server sends to your web browser when you access our Website(s). Every computer that accesses our Website(s) is assigned a different Cookie. Cookies can store many types of non-identifiable data. Cookies may be used to help us analyze usage of our Website(s) or to restrict underage use of the Website(s). We do not link basic data from Cookies to Personally Identifiable or Health Information without your permission, and we do not use Cookies to collect or store Personal Identifiable or Health Information about you.

Most browser software can be set to reject all Cookies. Note, however, that some portions of our Website(s) may not work properly if you reject Cookies.

IP Addresses

Our Website(s) may also receive IP addresses in the normal course of the operation of our Website(s). An IP address is a number assigned to you by your Internet service provider so you can access the Internet. Although we do receive IP addresses, we do not use them to identify you personally or disclose them to others.

Web Logs

Website(s) use standard Web Logs that record basic data about your visit to our Website(s), such as the date and time of the visit, the pages viewed during the visit and the domain name of your Internet service provider.

Normally, Data Processors do not seek to identify individuals from Web Logs. However, Web Logs may be used to identify an individual whom we suspect tried to damage our Website(s) or use them in an unauthorized way. The Data Processor may share the Web Logs with law enforcement agencies if we believe there has been a violation of computer security or related laws or as otherwise required to comply with applicable law or legal process.

In addition, Web Logs (which do not contain any Personal Identifiable Information) may be shared with our partners to assist them in better designing web sites for clinical research.

Google Analytics

Our Website(s) may use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) which uses cookies to help analyze how users use the Website(s). The information generated by accepted cookies about your use of the Website(s) - including your IP address - will be transmitted to and stored by Google [on IQVIAs behalf] under Google’s privacy policy, which you can access here:

Data Protection Rights

As a person affected by our data processing, you have certain rights:

  1. Right to request access: You have a right to be provided with access to any data held about you and to request a copy of the personal information (data) collected about you.
  2. Right to request rectification: You have the right to request the completion or rectification of incorrect personal information (data) concerning you if it is incorrect or incomplete.
  3. Right to request erasure: You may request the deletion of your personal information (data). If applicable, we will take reasonable steps to inform other controllers that are processing your personal information (data) we shared with them that you have requested the erasure of any links to, copies or replication of it.
  4. Right to request restriction of processing: You may request the restriction of the processing of certain personal information (data) for the duration of a complaint procedure or for specific other reasons.
  5. Revocation of consent: In general, we only process your information (data) to fulfil the contract or indicated purposes and do not ask for your consent for any further processing. If you have nevertheless given us your consent to further processing of your personal information (data) in individual cases, you can revoke this consent and prevent further information (data) processing, provided that no other justification is relevant. This right of revocation does not apply to the data that we store for the purpose of fulfilling the contract or indicated purposes.
  6. Right to request data portability: You may request that we electronically transfer your personal information and data that you have provided to us, and which we have still stored, to another responsible party (data controller).
